Hunter Biden, 52, will plead guilty to the misdemeanor tax offenses as part of an agreement made public Tuesday.
President’s Son Pleads Guilty to Tax Offenses
The president’s son agreed to plead guilty to two misdemeanor counts of willful failure to pay federal income tax. Records show he owed at least $100,000 in federal taxes for 2017, and at least $100,000 in 2018, but did not pay what was due to the Internal Revenue Service by the deadlines.
His carefully crafted agreement also allows him to enter into a pretrial diversion agreement regarding a separate charge of possession of a firearm by a person who is an unlawful user of or addicted to a controlled substance, as long as he adheres to conditions set by prosecutors.
The U.S. Attorney for the District of Delaware David C. Weiss said in a statement, “Hunter Biden received taxable income in excess of $1,500,000 annually in calendar years 2017 and 2018. Despite owing in excess of $100,000 in federal income taxes each year, he did not pay the income tax due for either year.”
Regarding the gun charge, the statement said, “From on or about October 12, 2018, through October 23, 2018, Hunter Biden possessed a firearm despite knowing he was an unlawful user of and addicted to a controlled substance.” Weiss’s office also said that its investigation of Biden is ongoing.
What Will Happen to Hunter?
Chris Clark, attorney for Hunter Biden, told NBC News, “Hunter will take responsibility for two instances of misdemeanor failure to file tax payments when due pursuant to a plea agreement. A firearm charge, which will be subject to a pretrial diversion agreement and will not be the subject of the plea agreement, will also be filed by the Government. I know Hunter believes it is important to take responsibility for these mistakes he made during a period of turmoil and addiction in his life. He looks forward to continuing his recovery and moving forward.”
The gun charge states Hunter Biden possessed a handgun, a Colt Cobra 38 special, despite knowing he was a drug user for 11 days in October 2018.
If convicted, Hunter Biden faces a maximum penalty of 12 months in prison on each of the tax charges which is about two years. There is a maximum penalty of 10 years in prison on the firearm charge however he agreed to a pretrial diversion program.
Legal experts believe it is unlikely Hunter Biden’s deal with President Joe Biden’s Justice Department will include any jail time, NBC News reported.
Hunter Biden’s plea deal with United States Attorney David Weiss appears to exclude the Biden $10 million “bribery” scheme an FBI informant documented and that Weiss reportedly obtained from former Attorney General William Barr.
