A transgender non-binary man is accused of targeting a 5-year-old boy who is autistic and is non-verbal.

Trans Non-Binary Person Charged With Sexual Assault

A person in Texas who identifies as transgender and non-binary has been charged with super aggravated sexual assault of a child under 6, possession with intent to promote child pornography, and two counts of sexual performance of a child under 14.

Kelvin Alexander Dias, a 23-year-old Texas resident who identifies as non-binary and uses she/her pronouns, was arrested on February 15 for allegedly sexually assaulting a 5-year-old boy with autism.

Dias has been charged with super aggravated sexual assault of a child under the age of 6, two counts of sexual performance of a child under the age of 14, and two cases of possession with intent to promote child pornography.

Boy Was a Target Because of His Handicaps

According to Luke Beatty, the chief of the Human Trafficking and Child Exploitation division at the Harris County District Attorney’s office, Dias allegedly targeted the non-verbal 5-year-old boy with autism because of his vulnerability and inability to communicate the abuse he was suffering.

“The National Center for Missing and Exploited Children (NCMEC) learned that there was child pornography flowing through his Twitter account,” Beatty said. Authorities were then able to track down Dias based on his IP address. Dias reportedly admitted to creating and uploading the content.

Among the child sexual abuse materials shared on Twitter by Dias were images of the victim. Representatives from NCMEC contacted the child’s mother, who confirmed the child’s identity.

Dias in Custody

Despite being taken into custody, Dias appeared unfazed. ABC13 reported that when approached by arresting officers, Dias allegedly admitted to planning to flee the country.

Dias, who is originally from Honduras, had been residing in Houston for the past four years and worked as a housekeeper for two years. The child victim was a friend of the family that had hired him.

According to reports, Dias allegedly indicated that he had another victim when he was arrested, but he refused to reveal the identity of the child to law enforcement.

Investigators are concerned there might be other victims out there.

Presiding judge Frank Aguilar set bond for Dias at $1.2 million at a hearing on February 20. He is currently in the custody of the Harris County Sheriff’s Office.
